The Board shall, where appropriate, take appropriate measures in accordance with the Rules of Procedure. Each ABC Authorization Holder is legally and professionally required to report to the relevant government agency any evidence of which it has knowledge in connection with the alleged criminal conduct of an ABC Authorization Holder in connection with the practice of orthotics, prosthetics and/or pediatrics. Failure to comply with this Code, including conduct that violates the moral principles, customs and practices of the profession, laws or regulations, may be subject to disciplinary action in accordance with the rules and procedures relating to the Code of Professional Liability (Rules). Disciplinary action depends on the circumstances and, but not limited to, how the conduct in question affects the dignity and integrity of the profession. The profession is primarily used to support patients in maintaining a functional life. The ABC Authorisation Holder is responsible for making the greatest possible effort to meet the patient`s orthopaedic, prosthetic and/or pedorthic requirements. How the patient is served is an essential factor for proper ethical professional conduct. Members of the profession are responsible for maintaining and promoting ethical practices, including but not limited to reporting unethical practices in accordance with this Code.

The holder of the ABC Credential has specific responsibilities to physicians and other duly authorized prescribers in health care, patients, the public, colleagues and the profession itself. These responsibilities must be fulfilled with honour and integrity to ensure public confidence in the profession. For the purposes of this Code of Professional Responsibility (Code), the term ABC Credential holder means any person, entity or organization that may or has applied for and received any of the certifications, accreditations or recognitions offered by the American Board for Certification in Orthotics, Prosthetics and Pedorthics, Inc. (ABC), including residents registered with the National Commission on Orthotic and Prosthetic Education (NCOPE). As used in this document, the Committee refers to the CBA`s Professional Ethics Commission.

Each ABC Accreditation Holder must promptly, completely and accurately disclose to ABC all investigations, results and actions of federal, state or local authorities: (i) orthopedic, prosthetic or pedorthic (OP&P) authorities or entities responsible for health licensing or monitoring or OP&P related licenses or certifications; (ii) government agency; (iii) quasi-governmental body; and/or (iv) Licensing Committee (individually an organization and collectively organizations). The ABC application holder`s disclosure obligation includes investigations conducted by federal, state or private payers. The ABC CRED holder disclosure requirement does not include general billing audits that are not specific to an ABC CRED holder. Each holder of ABC identification securities must make such a disclosure to ABC within 30 days of becoming aware of the commencement of an organization`s actions. Each ABC Certification holder must cooperate promptly and fully with ABC, the Committee and the Agencies.
