You hereby grant Apple the right to take any action that Apple reasonably deems necessary or appropriate to enforce and/or verify compliance with any part of this Agreement. You agree that Apple has the right, without liability to you, to disclose data and/or information to law enforcement, government officials, and/or third parties as Apple reasonably deems necessary or appropriate to enforce and/or verify compliance with any part of this Agreement (including, but without limitation, Apple`s right to respond to legal proceedings related to your use of the Services). and/or content. and/or a third party alleges that your use of the Services and/or Content is illegal and/or violates the rights of such third parties). You must be 13 years old (or equivalent age in your home country, as determined in the Apple ID creation process) to create an account and use our Services. Apple IDs for people under this age can be created by a parent or guardian through Family Sharing or an approved school. A parent or guardian who creates an account for a minor should review this Agreement with the minor to ensure that both understand it. Your use of our Services is governed by Apple`s Privacy Policy, available at www.apple.com/legal/privacy/. If your primary payment method is used for any reason (for example, expiration or insufficient funds), allow Apple to attempt to charge your other eligible payment methods from top to bottom, as described on the payment page in your account settings. If we are unable to charge you, you remain responsible for any uncollected amounts and we may attempt to charge you again or ask you to provide another payment method. If you pre-order content, you will be charged a fee when the content is delivered to you (unless you cancel before the content is available).

Content shared by family members or acquired through content codes is generally not subject to a purchase requisition; Content codes that facilitate access to subscriptions are subject to a purchase request. The Organizer must be the parent or guardian of a family member for whom Request Purchase Authorization is enabled. The purchase requisition is enabled by default for all family members under the age of 13 (or equivalent age in their home country) and will remain active until the parent or guardian deactivates it. If the purchase requisition is deactivated after the family member turns 18, it can no longer be activated. For the “Request to purchase”, the purchase release does not need to be activated. Apple acts as an agent for App Providers in connection with the operation of the App Store and is not a party to the purchase agreement or user agreement between you and the App Provider. However, if you are a customer of Apple Distribution International Ltd., the reseller of record is Apple Distribution International Ltd., which means that you purchase the license for the application from Apple Distribution International Ltd., but the application is licensed by the application provider. An Application licensed by Apple is an “Apple Application”; An application licensed by an application provider is a “third-party application”. Each Application you purchase is subject to the Licensed Application End User License Agreement (“Standard EULA”) set forth below, unless Apple or the Application Provider provides a global custom license agreement (“Custom EULA”). The application provider of a third-party application is solely responsible for its content, warranties and claims you may have with respect to the third-party application, subject to local laws. You acknowledge and agree that Apple is a third-party beneficiary of the standard EULA or custom EULA applicable to each Third Party Application and may therefore enforce this Agreement.

BY USING THE SERVICES, YOU AGREE TO INDEMNIFY AND HOLD HARMLESS APPLE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS AND LICENSORS, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FROM AND AGAINST ANY CLAIM ARISING OUT OF YOUR BREACH OF THIS AGREEMENT, YOUR USE OF THE SERVICES, OR ANY ACTION TAKEN BY APPLE IN CONNECTION WITH THE INVESTIGATION OF AN ALLEGED BREACH OF THE SERVICES. OR AS A RESULT OF A DETERMINATION OR DECISION THAT A VIOLATION OF THIS AGREEMENT HAS OCCURRED. YOU AGREE NOT TO SUE APPLE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS AND LICENSORS, OR TO OBTAIN DAMAGES FROM APPLE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS AND LICENSORS IF APPLE HAS DECIDED TO REMOVE OR DENY ACCESS TO ANY INFORMATION OR CONTENT, SUSPEND OR TERMINATE YOUR ACCESS TO THE SERVICES. OR TAKE ANY OTHER ACTION DURING THE INVESTIGATION OF AN ALLEGED BREACH OR AS A RESULT OF APPLE`S DETERMINATION THAT A BREACH OF THIS AGREEMENT HAS OCCURRED. THIS WAIVER AND INDEMNIFICATION PROVISION APPLIES TO ALL BREACHES DESCRIBED OR CONTEMPLATED IN THIS AGREEMENT. E. NO WARRANTY: YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, THE LICENSED APPLICATION AND ALL SERVICES PROVIDED OR PROVIDED BY THE LICENSED APPLICATION ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND LICENSOR HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE LICENSED APPLICATION AND ALL SERVICES, LET THEM BE EXPRESS. IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT. NO ORAL OR WRITTEN INFORMATION OR ADVICE FROM LICENSOR OR ITS AUTHORIZED REPRESENTATIVE SHALL CREATE ANY WARRANTY.
