Is It Legal to Have a Pet Turtle in Hawaii

By October 25, 2022No Comments

Most of these “new” tourists are “voice” travelers and don`t have to spend that money on vacation. Each state has very specific laws regarding turtles, especially turtle species native to the region, sometimes these laws are specific to a single state and do not apply to other states. So let`s take a closer look at Hawaii`s exact turtle laws. We are really lucky on the Kohala coast of the Big Island, because apparently the Honu find it as pleasant to live and visit as we do! Most sheltered bays along the Kohala coast are home to turtles, so swimmers, snorkelers, and divers are likely to encounter them frequently in shallow water. Turtles often sunbathe on Anaeho`omalu Beach and have recently invaded fish ponds. Anaeho`omalu`s glass-bottom boat drifts almost daily over a spot on the reef where the Honu congregate to be cleaned, and when the turtles are not at their cleaning station, they usually graze on the reef or emerge to breathe. We always see green sea turtles snorkeling, but about 5 years ago we had a great experience. We snorkeled on one of Wailea`s beaches, and I had my phone in my Ugo (a zippered waterproof pocket that allows you to use your phone underwater). A sea turtle swam right next to us, then came back in our direction, so I started shooting.

When I saw the video later, we not only saw the turtle, but there was a whale song as background music! This information should cover the basics of what you need to know about sea turtle laws. If you want to get a permit to work with sea turtles, you should visit the Fish and Wildlife Government website, where you will find all the details you need: www.fws.gov. Here are some (but not all) animals that can be legally brought to Hawaii or possessed: Once the inspection is complete and all entry requirements are met, the turtles can be released to the importer. This means that feeding or touching turtles is considered a nuisance in some way and therefore illegal. DLNR advises the public to keep a 6- to 10-foot buffer zone as a best practice for sea turtle viewing. In 1975, the U.S. government passed regulations with the stated goal of protecting sea turtle eggs, reducing environmental damage, and reducing health risks. In short, this law makes it illegal to sell turtles under 4 inches. Here is the law. If you want to study sea turtles, you will need a service and/or state permit. Any activity that exceeds the limits of state authority for an endangered species requires a federal permit in addition to state approval. (a) Definition.

As used in this section, the term “turtles” includes all animals commonly known as turtles, turtles, pond turtles and all other animals of the order Testudinata, class Reptilia, with the exception of marine species (families Dermochelyidae and Cheloniidae). A 60-year-old visitor to Ka`anapali Maui from Georgia pulled a state-protected green sea turtle out of the water last week. He said he was “very sorry” and did not know his actions were illegal. Huh? DLNR rightly said that ignorance of the law is not a defence. In Hawaii, sea turtles are protected by the Revised Hawaii Statute (Chapter 195D) and the Hawaii Administrative Rules (13-124). Although federal and state conservation laws differ in some ways, all actions that could injure, injure, kill, or disturb sea turtles without permission are prohibited. Feeding or touching turtles in any way is considered a nuisance and therefore illegal. While turtles lay their eggs on Hawaii`s beaches, it is estimated that more than 90 percent of them migrate to schools of French frigates (islands about 680 miles northwest of Anaeho`omalu Bay) to do so. Why turtles sunbathe here on beaches is not really understood. For a long time, researchers thought about lying in the sun to warm the turtle, which helped it digest its food faster.

But after measuring the indoor temperature of solar turtles (which isn`t that simple — they were rectal thermometers and relatively cooperative turtles) and finding that they`re not much warmer than in the ocean, researchers are now starting to think that shooting them on windy beaches could be a way for the turtle to dodge its predators. One of my first trips to Maui was a large sea turtle lounging on the beach. I was so excited. I was standing next to me to take a picture. I didn`t touch him, but boy, when I posted the picture, I must have been yelled at! These are Hawaiian laws regarding turtles. Laws can sometimes be very fuzzy and difficult to understand, so I did my best to simplify them without losing their meaning. One last thing I want to mention is that state laws don`t always completely cover all turtle species, they usually focus on native species, so if you`re still not sure if you can own or sell a particular turtle species, you should visit the resources section, there you will find a link to the State Department that deals with wildlife. This is where I did the research for this article, their website also includes a contact page where you can get in touch with them if you have a specific question. The fine for harassing or touching a sea turtle in Hawaii is $1,000 to $10,500. The crime must be reported to the police so that action can be taken. Sighting guidelines: Turtles are generally not afraid of humans. However, they are protected by law and it is illegal to touch them, as has been done here.

Do not hunt or frighten turtles, prevent their movement or swim within 20 feet. In addition to the requirements of the Ministry of Agriculture, you must also consider the requirements of airlines regarding pets. Careful preparation and planning is also required for the flight of your pets to Hawaii. I love hearing this from visitors like you. I was on my beach in Maui a few weeks ago and a lifeguard had to tell a tourist 3 times to leave the turtle alone and had to threaten to call the police. We do not need these people. Turtle species and turtles authorized for import into Hawaii must meet the following requirements: States may issue permits to capture and store sea turtles under the auspices of their Article 6 ESA agreements with the Service. However, endangered species require a service permit in the following circumstances: It is also illegal to destroy or disturb sea turtle nests. In addition, the eggs of the sea turtle should not be sold or disturbed under any circumstances. Of the 7 species of sea turtles, only 2 are found in coastal waters – the Pacific green turtle (called Honu in Hawaiian) and the hawksbill turtle (in Hawaiian, `Ea).

However, only the Honu can be seen frequently. When a sea turtle “yawns,” it`s irritated that you`re invading its space. When he turns his fin above his head, he tries to sweep you. Is it illegal to own turtles in Hawaii? No, you can legally own a turtle in Hawaii, it all depends on the species. Some endangered species are protected by law and are illegal to own, but most of the most common species are not endangered and you can own them as pets. There are 7 different species of sea turtles, and all of them are endangered or endangered. In all states, therefore, they are protected by law. This means that you cannot own or trade sea turtles of any kind. It is illegal to sell or trade endangered or endangered turtle species in any way. HONOLULU – The Department of Lands and Natural Resources (DLNR) is reminding the public to respect Hawaii`s sea turtles by looking at these protected animals responsibly. Another reason they exist is to protect the environment. Many people believed that if they didn`t want a turtle as a pet, they could simply release it into the nearest forest or lake without consequences, but this is not the case.

Each ecosystem has its own balance and the addition or extraction of a species from it can greatly destabilize this balance. That is another reason why these laws exist. 1. Green: Protected by the Endangered Species Act and weighing up to 500 pounds, their lifespan is considered very long. Green turtles live near the coast of our islands, feeding mainly on algae and swimming up to 35 miles per hour. As one of the oldest species in the world, they existed before dinosaurs.
