Factoring Legal Aspects

In a world where things are becoming increasingly uncertain, companies involved in trading need to understand the legal aspects. The authors analyze the main features, benefits and costs of factoring implementation by small and medium-sized enterprises (with a particular focus on the use of factoring in the service sector) and show that the use of factoring can improve the profitability, liquidity and cash flow of the company, as well as time risk management, credit and default. However, the use of factoring is limited due to many limitations and hidden costs arising from the legal environment. The authors point out that the legal environment of factoring is crucial to reduce transaction costs and improve the costs and process of determining the titles of each factoring transaction in each country.
